Sole proprietorship / business license questions

Can anyone provide some information on the legal requirements for starting a sole proprietorship in the state of IL? I have been selling online for some time and I want to make sure that all my bases are covered.

Contact your county clerk's office. I'm pretty sure that anything not LLC or INC is dealt with by the county or city.

In most states the DBA is usually handled by the county clerk. If you want information on a sole proprietership then you would have to search on the State's website. In your case it would be illinois.gov

It depends on your county/city laws.

In the city here, you need a business license for anything, the basic license in Huntsville is like $28 and then the renewals are based on revenue (no clue as to amounts). In Athens (AL) where I lived when I started this, it would have cost around $400 to get a license because I'd have needed special permission to run a business in a residential zoned area, etc etc etc (buncha bureaucratic crap mainly) so I used an address I own in the county for the business mailing address. In the county (Limestone and most other AL counties) you don't need a license for a "service based" business so I didn't even bother with the license just got a DBA at the bank and went with it. Later on I went with an LLC registration and that's where I am now.

What will work in your neck of the woods you'll just have to find out, call the county clerk and see what they say.

In my country, Sole Proprietorship doesn't need any license (well, except a brief business plan signed on a seal).

But It cost around . . . $50,000 to start a corporation here. (Is it Inc? Don't know for sure)

I think you'll find everything you need on your states websites.

I just finished doing some paperwork for the state (I live in Chicago area - cook county)

You can go to the state's website, and get your IBT and FEIN online. http://www.revenue.state.il.us/Businesses/

Get your DBA from your county clerk's office, for cook county, you get can the forms online, http://www.cookctyclerk.com. I'd recommend using the Chicago Tribune to publish the legal notice - they take care of nearly everything for you as far as your DBA goes. ChicagoTribune.com; legals@chicagotribune.com.

Business License would be obtained for your business from your city. Most cities/towns don't have any specific requirements for web-based businesses other than requiring registration (license)

For sole proprietorship in cook county there was legal requirements except for the specific licences for the line of buiness. For web hosting there are no licence required. But it seems there is some changes recently. Few weeks back when I was talking to local bank they wanted the the DBA, which you can get from count clerks office for $10 or so. Few months back you didn't even needed the DBA. Check the spefic buiness you are planning require any license at http://www100.state.il.us/businesscenter/busstart.cfm

I live in Chicago aswell. In Illinois all that is required for a sole proprietship is a tax number, thats your social security number. I recommend using an alias ie. the name of your company.

With an alias for a sole propierter you have to get a form from the county clerk and in Illinois take out an add for an assumed name (your alias/company name). After your add has run for those three weeks you get a reciept from the Newspaper which you bring back to the county clerk.

Boom Badda Bing Badda Boom your all set and you can get a new taxpayer ID (not your social) which comes in handy for all sorts of things.

"Sole Proprietorship" is a nebulous thing. If you cut your neighbor's grass for ten bucks, you're a sole proprietor. A business license isn't necesarily required (unless local law stipulates it).

In most places the business license is handled at the municiple level. Most places I've been don't require it to just "work" or otherwise perform services. Each municipality has their own definitions of what constitutes a business and requires a license.

One thing I've discovered, is that if you ask at the county office they are--of course--gonna tell you that you need one. This may not actually be true. I once had two different counties telling me I needed to pay each for a business license...for the same business! Ultimately, I never got a license with either.

But, to go beyond that, the biggest reason you need to forget the business license/sole proprietor route is that you need to protect yourself from liability. What are you gonna do when Joe Blow claims he lost a million dollar sale 'cause his site was down? I know that's a extreme example, but it's not the normal things in life you need protection from. In my opinion, you should form an LLC or incorporate to protect yourself.
